Terms of Service
VisitCare
Last updated: October 21, 20261. Introduction
These Terms of Service ("Terms") govern access to and use of VisitCare, a software-as-a-service platform designed for beauty, wellness, and other appointment-based businesses.
By creating an account, registering a business, starting a trial, purchasing a subscription, or otherwise accessing or using VisitCare, you agree to these Terms.
If you are using VisitCare on behalf of a business or organization, you represent that you are authorized to accept these Terms on behalf of that organization.
If you do not agree to these Terms, you must not use VisitCare.
2. The VisitCare Service
VisitCare provides software tools designed to support appointment-based business administration and operational workflows, including functions that may include: client management; appointments and calendar management; service configuration; automated WhatsApp messaging (confirmations, reminders, follow-ups, recall, and review requests); a public booking page; user and permission management; subscription and account management.
Features may vary depending on the selected subscription plan, platform configuration, and product development. VisitCare may modify, improve, add, remove, or replace features from time to time.
3. Professional Use Only
VisitCare is intended for professional and business use. Businesses and their authorized users are responsible for ensuring that their use of VisitCare complies with all laws, licensing requirements, privacy requirements, and professional standards applicable to their activities. VisitCare does not provide legal, tax, or accounting advice.
4. Account Registration
Users must provide accurate and current information when creating an account. Users are responsible for maintaining the confidentiality of their login credentials, protecting access to their accounts, using appropriate passwords and security measures, ensuring that only authorized individuals use their account, and promptly notifying VisitCare of suspected unauthorized access or security incidents.
5. Business Registration and Administration
A business account must be created before protected functionality can be used. The user who creates a business may be assigned owner or administrator privileges. Business owners and administrators are responsible for managing business information, authorized users, roles and permissions, business settings, subscription management, and compliance with applicable laws.
6. Trial Period
Eligible new subscriptions may include a 14-day free trial. Where a payment method is collected during registration, no subscription fee is intended to be charged during the free trial. Unless the subscription is cancelled before the end of the trial, the selected paid subscription may begin automatically at the end of the trial and the applicable fee may become payable. Trial eligibility may be limited to one trial per customer, business, or related account identifier. VisitCare may refuse or terminate duplicate, fraudulent, abusive, or repeated trial registrations.
7. Subscription Plans
VisitCare may offer different subscription plans. Features, user limits, and billing intervals may differ between plans. The current subscription plan and billing interval are displayed within the platform where applicable.
8. Subscription Fees
Subscription fees are shown before purchase or subscription confirmation. Fees are prepaid for the applicable billing period and may be charged monthly, annually, or according to another agreed billing interval. Unless otherwise stated: fees are exclusive of any applicable taxes; subscriptions renew automatically until cancelled; the customer authorizes the payment provider to charge the applicable recurring fees. VisitCare may change future subscription pricing, with reasonable notice provided where required before a price change becomes effective for an existing subscription.
9. Payment Processing
Subscription payments may be processed by third-party payment providers: Base44 Payments, powered by Wix Payments, and Stripe. VisitCare does not intentionally store full payment card numbers. The customer is responsible for maintaining a valid payment method.
10. Failed Payments
If a subscription payment fails, VisitCare may mark the subscription as past due. A temporary grace period may be provided during which the business may continue to access the service. If payment is not completed within the grace period, access to certain write functions may be suspended.
11. Suspension and Read-Only Access
VisitCare may suspend or restrict account functionality where: subscription fees remain unpaid; the subscription has ended or been cancelled and the paid billing period has expired; the account presents a security risk; the user materially breaches these Terms; or continued use may violate applicable law or compromise the platform. Where appropriate and technically available, suspended businesses may retain read-only access to stored information. Suspension does not automatically mean that business data is immediately deleted.
12. Cancellation
Monthly and annual subscriptions are prepaid. You may cancel automatic renewal at any time before the next renewal date. Cancellation stops future renewals only and does not affect the current paid billing period.
Access remains active until the end of the already paid monthly or annual billing period. After the paid period ends, the subscription does not renew and access is suspended.
No automatic prorated refunds are issued for unused time after an ordinary cancellation. Fees paid for the current billing period are non-refundable, except where a legally required refund applies.
Mandatory statutory rights and any legally required refunds remain unaffected by these cancellation terms.
If you cancel during the 14-day free trial, before the first paid billing period begins, the first subscription charge is prevented and no subscription fee becomes payable.
13. Reactivation and Plan Changes
Where supported, a subscription scheduled for cancellation may be reactivated before the end of the current billing period. Customers may be permitted to upgrade or downgrade between plans, subject to prorated billing adjustments and plan-specific limits. A downgrade may be blocked where the business currently exceeds the limits of the target plan.
14. Customer Data
The business retains responsibility for the client, appointment, operational, and other data entered into VisitCare by or on behalf of the business. As between VisitCare and the business, the business remains responsible for determining what information is entered, why it is processed, who is authorized to access it, and how long it should be retained. VisitCare does not acquire ownership of business client records merely because they are stored or processed through the platform.
15. Data Isolation and Access
VisitCare is designed as a multi-tenant platform. Users must not attempt to access data belonging to another business without authorization, and must not bypass, disable, interfere with, or circumvent access controls or security mechanisms.
16. Acceptable Use
Users must not use VisitCare: for unlawful purposes; to infringe intellectual property or privacy rights; to upload malware or malicious code; to attempt unauthorized system access; to interfere with platform availability; to conduct unauthorized security testing; to impersonate another person or organization; to transmit fraudulent, deceptive, abusive, or unlawful content; or in a way that could damage VisitCare, its infrastructure, or other users.
17. Intellectual Property
VisitCare, including its software, interface, workflows, branding, design, documentation, source code, and other proprietary materials, is protected by applicable intellectual property laws. Except for the limited right to use the service under these Terms, no ownership rights in VisitCare are transferred to the customer. Customers may not copy, resell, sublicense, reproduce, reverse engineer, or create derivative works from the platform except where prohibited by applicable law.
18. Feedback
If users voluntarily provide suggestions or feedback concerning VisitCare, VisitCare may use that feedback to improve the platform without obligation to compensate the user, provided such use does not disclose confidential client information.
19. Third-Party Services
VisitCare may integrate with or rely on third-party services, including payment providers (Base44 Payments, powered by Wix Payments, and Stripe), messaging providers (Twilio, Meta/WhatsApp), email providers, and hosting/infrastructure providers (Base44). Third-party services may be governed by their own terms and privacy policies. VisitCare is not responsible for the independent operation, availability, or failures of third-party services outside its reasonable control.
20. Availability and Maintenance
VisitCare aims to provide reliable service but does not guarantee uninterrupted or error-free availability. The platform may be temporarily unavailable due to maintenance, updates, infrastructure or third-party service failures, internet outages, security incidents, or force majeure events.
21. Backups and Business Continuity
VisitCare may implement backup, redundancy, and continuity measures according to its infrastructure practices. However, businesses remain responsible for maintaining any independent copies, exports, or records they require outside VisitCare.
22. Security
VisitCare uses reasonable technical and organizational safeguards designed to protect the platform and its information. No software system can guarantee absolute security. Users must promptly notify VisitCare if they discover or reasonably suspect unauthorized access, compromised credentials, security vulnerabilities, data exposure, or misuse of an account. Security inquiries may be directed to support@visitcare.io.
23. Privacy
Use of VisitCare is also governed by the VisitCare Privacy Policy.
24. Data Export and Account Termination
Where supported by the platform, businesses may be able to export certain information and should complete any necessary export before requesting deletion of a business or account. Termination, cancellation, or expiration of a subscription does not necessarily result in immediate deletion of all data; data may be retained where required for legal, regulatory, accounting, security, or other legitimate operational requirements.
25. Account and Business Deletion
VisitCare may provide functionality to request deletion of a user account or business. Deletion requests may require verification and may be subject to applicable retention obligations. Deletion of a business may affect all users and data associated with that business. Business owners and administrators are responsible for ensuring any required records are exported or preserved before requesting deletion.
26. Disclaimer of Warranties
To the maximum extent permitted by applicable law, VisitCare is provided on an "as available" and "as is" basis. VisitCare does not warrant that the service will always be uninterrupted, that every feature will always be available, that the platform will be error-free, or that third-party services will remain available. Nothing in these Terms excludes warranties or rights that cannot legally be excluded.
27. Limitation of Liability
To the maximum extent permitted by applicable law, VisitCare and its operator will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profit, revenue, business opportunity, goodwill, or anticipated savings arising from use of the service. VisitCare is not responsible for losses caused by inaccurate information entered by users, unauthorized use of user credentials, third-party service failures, internet or infrastructure failures outside reasonable control, or misuse of the platform. To the extent permitted by law, the aggregate liability of VisitCare arising out of or relating to the paid service will not exceed the subscription fees actually paid by the relevant customer during the twelve months immediately preceding the event giving rise to the claim. This limitation does not apply where liability cannot legally be limited or excluded.
28. Indemnification
To the extent permitted by applicable law, a business or customer agrees to be responsible for claims, losses, or costs resulting from unlawful use of VisitCare, breach of these Terms, unauthorized use of client information, or content or data uploaded by or on behalf of the business. This provision applies only to the extent legally enforceable.
29. Termination by VisitCare
VisitCare may suspend or terminate access where reasonably necessary because of material breach of these Terms, unlawful activity, non-payment, security threats, fraudulent conduct, abuse of the service, or legal or regulatory requirements. Where reasonably possible, VisitCare may provide notice and an opportunity to remedy the issue before termination.
30. Changes to the Service
VisitCare may change or improve the service over time. Features may be added, modified, replaced, or discontinued. Where a material change significantly affects paid customers, VisitCare may provide reasonable notice where appropriate.
31. Changes to These Terms
These Terms may be updated from time to time. The current version will be published on this page together with the applicable "Last updated" date. Continued use of VisitCare after updated Terms become effective may constitute acceptance of the updated Terms where permitted by applicable law.
32. Governing Law
These Terms are governed by the laws of Romania, without prejudice to any mandatory consumer or other statutory rights that cannot legally be excluded. Where legally permissible, disputes relating to these Terms or the VisitCare service will be subject to the competent courts in Romania.
33. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.
34. Entire Agreement
These Terms, together with the Privacy Policy and any applicable subscription or other written agreement, constitute the agreement governing use of VisitCare. If a separate written agreement expressly conflicts with these Terms, the separate written agreement will prevail to the extent of that conflict.
